Tadoba Safaris and Stays (“we”, “us”, “our”) respects the intellectual property rights of others and expects the same of our guests, partners, and visitors. If you believe that material available on this website infringes a copyright you own or control, you may notify us in accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512). On receipt of a valid notice, we will act expeditiously to remove or disable access to the material in question.

Filing a DMCA takedown notice

To be effective under § 512(c)(3)(A), your written notice must include all of the following:

  • A physical or electronic signature of the copyright owner, or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed — a specific work, or a representative list if multiple works at a single site are covered by one notice.
  • Identification of the material claimed to be infringing, with information reasonably sufficient to permit us to locate it — typically the full URL on this website along with a description of the work.
  • Your contact information: full name, mailing address, telephone number, and email address.
  • A statement that: “I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”
  • A statement, made under penalty of perjury, that: “The information in this notice is accurate, and I am the copyright owner, or am authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.”

We strongly recommend sending notices by email so we can respond as quickly as possible. Incomplete notices may delay our response.

Counter-notice procedure

If your content was removed or disabled and you believe in good faith that this was the result of mistake or misidentification, you may file a counter-notice under § 512(g). Your counter-notice must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled and the location (URL) at which it appeared before removal.
  • Your full name, mailing address, telephone number, and email address.
  • A statement, made under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  • A statement that you consent to the jurisdiction of the United States federal district court for the judicial district in which your address is located, or — if your address is outside the United States — any judicial district in which we may be found, and that you will accept service of process from the person who provided the original notice or their agent.

Response timing

On receipt of a valid DMCA notice, we will act expeditiously to remove or disable access to the material identified and will notify the user who posted it. If we receive a valid counter-notice, we will forward it to the original complainant. Unless the complainant files a court action seeking a restraining order against the user within ten (10) to fourteen (14) business days of our receipt of the counter-notice, we may restore the removed material.

Repeat infringer policy

In accordance with § 512(i), we maintain a policy of terminating, in appropriate circumstances, the accounts or upload privileges of users, contributors, or partners who are determined to be repeat infringers of copyright.

Misrepresentations & false claims

Section 512(f) of the DMCA provides that any person who knowingly materially misrepresents that material is infringing — or that material was removed or disabled by mistake or misidentification — may be liable for damages, including costs and attorneys’ fees incurred by us, by the alleged infringer, or by the copyright owner. Please consider these consequences before submitting a notice or counter-notice.
